Premises Liability

Deaths from carbon monoxide are quite rare in a statistical sense, but when they do occur the results and details are often nothing short of tragic. Apparently, that was the case in Boca Raton over the weekend, as a schoolgirl sleep-over turned out to be deadly for two girls who were killed as a result of carbon monoxide poisoning. It appears that the cause of their deaths was from a car that was left running in the garage.

According to the Sun-Sentinel:

“Wilson told investigators that she and the girls had returned home from a trip to Wal-Mart at about 10:30 p.m. Saturday, parked the Ford Escape in the garage, closed the garage door behind them and went to bed. Wilson said she could not shut off the vehicle’s engine, according to Barbera.

Brondolo said today she wasn’t aware that her daughter had been out shopping so late, saying her normal bedtime was 9:30 p.m.

She said she was astonished that Wilson may have left a car running in the garage.

“I know Loretta is a single mom, but she has neighbors she could have asked for help,” Brondolo said. “She could have called my husband.”

Fire-rescue workers found Loretta Wilson, along with the family dog, outside and in front of the house. The family dog was taken into custody by Animal Care and Control and is recovering.”

While it appears that no foul play is involved with this situation per a statement from police, this could represent extreme negligence, depending on the rest of the facts of the situation.
